The»Rules«: General conditions for delivery and payment (extracts)

Before you order goods you are asked to pay attention to the following parts of the treatment. They are always the basic conditions for which we are providing our goods and services. Divergences are possible but they must be consented to by both sides and have to be written down.

Prices

All prices are for one thing each, other kinds of prices please do not hesitate to ask for. Our prices include delivery from the store, if not announced differently,  usual package and loading.  Not included are  lean packages like Euro-arrange or grit boxes.

Samples

With samples of bricks and natural stones and other goods which were a part of old buildings  differences in measures, structures, colours, textures and other characteristics which come from the former usage are typical. A sample is, that for,  only an example of the amount. Differences in characteristics which are not assured directly are no failure.

Order Confirmation

Orders have to be confirmed in a written way.

Delivery

The goods have to be removed immediately or at the agreed date of delivery. If the customer picks the things by himself or he instructs a freight forwarder, the risks for the goods pass to the customer after the loading immediately. If we are instructed to deliver the goods, of course, we bear the transport risks until the agreed place of handover. Lean packages have to be given back immediately for risk and weigh of the customer. We are allowed to deliver up to  5 % more or less amounts, you pay for the delivered amount.

Payment

Our requirements are to be payed cash or by card if you pick up the things by yourself. For delivery prepayment is valid explicitly.

Retention of title

The goods stay in property of the Olaf Elias Historische Bauelemente until full payment.

Defects

Complaints can only be taken into consideration if they are enforced immediately after taking over and in each case before they are used or  further processed. In case of a our liability we deliver a substitute, take the goods back for purchase credit or repare.

In case of delivery or processing of woods and natural stones and other goods which were a part of old buildungs  differences in measures, structures, colours, textures and other characteristics which come from the former usage are typical. Differences in characteristics which are not assured directly are no defect of the bought things.

Besides, the above mentioned things are fragile and that is why fracture up to an amount of 3% per delivery does not enable to  replacement requirements.

Performance is Marwitz. Jurisdiction is in our choice  Berlin or the jurisdiction of the customer. Privity between us and the customer is based on law of the Federal Republic of Germany.
